PeerNextNY, Inc. (the “Organization,” “we,” “us,” or “our”) is a New York not-for-profit corporation.

These Terms of Service (“Terms”) govern your access to and use of this website and any related online services, content, forms, and communications we provide (collectively, the “Site”).

  1. Acceptance of These Terms

By accessing or using the Site, you agree to these Terms.

If you do not agree, do not use the Site.

If you are using the Site on behalf of an organization, you represent that you have authority to bind that organization.

  1. What PeerNextNY Is (and Is Not)

PeerNextNY, Inc. supports individuals as they transition back to everyday life after medical or psychiatric treatment through peer-driven, non-medical recovery support, community connection, and advocacy for healthy living.

We are not a medical or clinical provider.

We do not diagnose, provide therapy, prescribe medication, or replace licensed healthcare providers.

Information on the Site is general and may not apply to your circumstances.

  1. Emergency and Crisis Disclaimer

The Site is not intended for emergency use.

If you are in immediate danger or experiencing a crisis, call 911 (or your local emergency number) right away.

You may also contact your licensed provider, local emergency department, or an appropriate crisis hotline in your area.

  1. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to use interactive features of the Site, such as contact, signup, volunteer, or donation forms, unless a parent/guardian provides consent where required by law.

  1. Permitted Use and Your Responsibilities

You may use the Site only for lawful purposes and in accordance with these Terms.

You may view and print portions of the Site for personal, noncommercial use.

You may not reproduce, distribute, modify, or create derivative works without our prior written consent.

We do not control and are not responsible for their content, policies, or practices.

  1. No Warranty

The Site is provided on an “as is” and “as available” basis.

To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Site will be uninterrupted, error-free, secure, or free of harmful code.

To the fullest extent permitted by law, PeerNextNY, Inc. and its directors, officers, employees, volunteers, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of use, data, profits, goodwill, or other intangible losses arising out of or related to your use of (or inability to use) the Site, reliance on any content, or participation in any activities referenced on the Site.

  1. Indemnification

You agree to defend, indemnify, and hold harmless PeerNextNY, Inc. and its directors, officers, employees, volunteers, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to

(i) your access to or use of the Site.

(iii) your violation of these Terms or any applicable law or regulation.

(iv) your infringement of any intellectual property or other rights of any person or entity.

This indemnification obligation includes, without limitation, claims brought by third parties arising from your acts or omissions.

  1. Suspension or Termination of Access

We may suspend or terminate your access to the Site (in whole or in part) at any time and for any reason, including if we believe you have violated these Terms, created risk for the Organization or others, or misused the Site.

We are not liable to you for any suspension or termination of access.

  1. Changes to the Site or Terms

We may update, modify, or discontinue the Site (or any portion of it) at any time without notice.

We may also revise these Terms from time to time.

When we do, we will update the “Effective Date” above.

Your continued use of the Site after changes become effective constitutes acceptance of the revised Terms.

  1. Governing Law and Venue

These Terms are governed by the laws of the State of New York, without regard to conflict of laws principles.

Any dispute arising out of or relating to these Terms or the Site shall be brought exclusively in the state or federal courts located in New York, New York, and you consent to the personal jurisdiction of those courts.

  1. Severability

If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in full force and effect.

The invalid or unenforceable provision will be enforced to the maximum extent permitted by law.

  1. Entire Agreement

These Terms (together with any policies referenced on the Site, such as a Privacy Policy if posted) constitute the entire agreement between you and PeerNextNY, Inc. regarding your use of the Site and supersede any prior or contemporaneous understandings.
